Kenya’s is not the first case where the manner and model of the ICC has been questioned. President Bill Clinton signed the ICC treaty on behalf of the United States on his way out of office in January 2000. Worried that the ICC had rough edges, he decided not to “recommend that my successor submit the treaty to the Senate,” as the nation needed “the chance to observe and assess the functioning of the Court before choosing to become subject to its jurisdiction.” President George W.
